1. About SPM Chess Academy

SPM Chess Academy ("SPM", "we", "us", or "our") provides online and offline chess coaching, demo sessions, tournaments, and supporting resources for children and families. These Terms apply to all visitors, parents, students, and any other users of our Services.

2. Eligibility and parent responsibility

Our coaching programs are primarily intended for children. However, accounts, payments, and formal agreements are handled with parents or legal guardians. By registering a child or using the Services on behalf of a child, you confirm that you are the parent or legal guardian and that you accept these Terms for yourself and the child.

You are responsible for ensuring that your child uses the Services appropriately and in compliance with these Terms, and for supervising their online activity where appropriate.

3. Accounts and security

To access certain parts of our Services, such as the parent portal or learning dashboard, you may need to create an account with a valid email address and password.

• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to notify us promptly if you suspect any unauthorized use of your account or any other security incident.
• SPM is not liable for losses arising from unauthorized use of your account if you fail to safeguard it.

4. Use of the Services

You agree to use the Services only for lawful purposes and in a responsible manner.

• Do not misuse or attempt to disrupt the website, learning portal, or any related systems.
• Do not share or distribute harmful, offensive, or unlawful content through our platforms.
• Do not attempt to gain unauthorized access to other users' accounts, data, or any non-public areas of our systems.
• Do not copy, redistribute, or sell access to our content, curriculum, or platform without our written permission.

5. Coaching programs, demos, and changes

We strive to provide a consistent and high-quality learning experience, but specific program details may evolve over time.

• Demo sessions are typically offered as an introduction to our coaching style and may be subject to availability.
• Batch timings, assigned coaches, curriculum details, and features of the learning portal may change to improve the overall experience.
• We reserve the right to modify, pause, or discontinue certain program offerings or features with reasonable notice where practicable.

6. Fees, payments, and refunds

Information about program fees, payment schedules, and any applicable taxes will be shared during enrollment or by our team. By confirming enrollment, you agree to pay the applicable fees.

Our detailed fee, payment, and refund policy may be communicated through email, invoices, or separate enrollment documents. In case of any conflict, the written terms shared at the time of enrollment will take precedence over this summary.

7. Intellectual property

All content provided through the Services—including lesson materials, assignments, puzzles, videos, branding, graphics, and software—is owned by SPM Chess Academy or our licensors and is protected by copyright and other intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable license to access and use the content solely for your personal, non-commercial learning purposes.
• You may not reproduce, distribute, modify, publicly display, or create derivative works from our content without prior written permission.

8. Student conduct and community standards

We expect students and parents to maintain a respectful environment during classes, tournaments, and on any online platforms managed by SPM.

• Be respectful toward coaches, staff, and fellow students at all times.
• Do not engage in bullying, harassment, or discriminatory behaviour.
• Follow coach instructions regarding camera/microphone use and online safety guidelines.
• Cheating in practice games or tournaments, including using external engines during supervised sessions, is not permitted.

We reserve the right to suspend or terminate access to the Services for behaviour that violates these standards, without refund, where the behaviour is serious or repeated.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data. Please read it carefully, as it forms part of these Terms.

10. Disclaimers

We aim to provide accurate information and a high-quality learning experience, but we do not promise that:

• The Services will be available at all times without interruption or errors.
• Any particular rating increase, medal, or tournament result is guaranteed.
• The content is free from all possible errors, although we work to keep it up to date and accurate.

The Services are provided on an "as is" and "as available" basis to the extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, SPM Chess Academy and its coaches, staff, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.

Where liability cannot be excluded, our total aggregate liability related to the Services will be limited to the amount you have paid for the relevant program or service during the twelve (12) months immediately preceding the event giving rise to the claim, to the extent permitted by law.

12. Suspension and termination

We may suspend or terminate access to all or part of the Services if you materially breach these Terms, engage in misuse or fraudulent activity, or where required by law or for security reasons. Where reasonable, we will provide notice of such action.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to applicable law, any disputes shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal.
